1. . INTRODUCTION
   1. Playbox is an online edutainment streaming platform where users can learn from the skills and stories of the best talent in South Africa across multiple skill categories.
   2. Playbox is owned and managed by Digital Planet (Pty) Ltd (DP). (“we,” “our,” “us” means Playbox) (“you,” “your” means the End User).
   3. These Terms and Conditions are binding and enforceable against every person that accesses or uses this Website (“you,” “your” or “user”), including without limitation each user who registers and/or subscribes to Playbox as contemplated below (“registered user”).
2. . GENERAL TERMS
   1. By accessing Playbox, you acknowledge that you have read and understood these Terms and Conditions and you agree to be bound by them. These terms apply to use of the website and any email or other type of communication between you and Playbox.
   2. If you do not agree with (or cannot comply with) these terms and conditions, then you should not use the Playbox website or the Services offered.
3. . COMMUNICATIONS

   By using our Service, you agree to subscribe to newsletters, marketing or promotional materials and other information we may send. However, you may opt out of receiving any, or all, of these communications from us by following the unsubscribe link or by emailing [email protected]

      By using the Site, you represent and warrant that:
      1. All registration information you submit is correct, accurate, current, and complete;
      2. You will maintain the accuracy of such information and promptly update such registration information as necessary;
      3. You have the legal capacity and you agree to comply with these Terms of Use;
      4. You are not a minor in the jurisdiction in which you reside;
      5. You will not use the Site for any illegal or unauthorized purpose; and
   2. If you provide any information that is untrue, inaccurate, not current, or incomplete, we have the right to suspend or terminate your account and refuse any and all current or future use of the Site (or any portion thereof).
4. . PURCHASES
   1. If you subscribe to Playbox, you may be asked to supply certain information, including but not limited to, your credit or debit card number, the expiration date of your card, your billing address, and your billing information.
   2. You represent and warrant that: (i) you have the legal right to use any card(s) or other payment method(s) in connection with any Purchase; and that (ii) the information you supply to us is true, correct, and complete.
   3. We may employ the use of third-party services for the purpose of facilitating payment and the completion of Purchases. By submitting your information, you grant us the right to provide the information to these third parties subject to our Privacy Policy.
5. . CONTESTS AND PROMOTIONS

   Any contests, or other promotions made available through the service, may be governed by rules that are separate from these Terms of Service. If you participate in any Promotions, please review the applicable rules as well as our Privacy Policy. If the rules for a Promotion conflict with these Terms of Service, Promotion rules will apply.

6. . SUBSCRIPTIONS
   1. The streaming service offered by Playbox is billed on a subscription basis ("Subscription(s)"). You will be billed in advance on a recurring and periodic basis ("Billing Cycle"). Billing cycles will be set depending on the type of subscription plan you select when purchasing a Subscription.
   2. At the end of each Billing Cycle, your Subscription will automatically renew under the exact same conditions unless you cancel it or Playbox cancels it. You may cancel your Subscription renewal either through your online account management page or by contacting the customer support team.
   3. A valid payment method is required to process the payment for your subscription. You shall provide Playbox with accurate and complete billing information that may include but is not limited to full name, address, province, postal or zip code, telephone number, and valid payment method information. By submitting such payment information, you automatically authorize Playbox to charge all Subscription fees incurred through your account to any such payment instruments.
   4. Should automatic billing fail to occur for any reason, Playbox reserves the right to terminate your access to the Service with immediate effect.
7. . FREE TRIAL
   1. Playbox may, at its sole discretion, offer a Subscription with a free trial for a limited period of time ("Free Trial"). You may be required to enter your billing information in order to sign up for Free Trial. If you do enter your billing information when signing up for Free Trial, you will not be charged by Playbox until Free Trial has expired. On the last day of the Free Trial period, unless you cancel your Subscription, you will be automatically charged the applicable Subscription fees for the type of Subscription you have selected.
   2. You represent and warrant that: (i) you have the legal right to use any card(s) or other payment method(s) in connection with any Purchase; and that (ii) the information you supply to us is true, correct, and complete.
   3. We may employ the use of third-party services for the purpose of facilitating payment and the completion of Purchases. By submitting your information, you grant us the right to provide the information to these third parties subject to our Privacy Policy.
8. . FEE CHANGES
   1. Playbox, in its sole discretion and at any time, may effect changes to Subscription fees for the streaming service. Any Subscription fee change will become effective at the end of the then-current Billing Cycle.
   2. Playbox will provide you with reasonable prior notice of any change in Subscription fees to give you an opportunity to terminate your Subscription before such change becomes effective. Your continued use of the Service after the Subscription fee change comes into effect will constitute your consent and agreement to pay the changed Subscription fee amount.
9. . CONTENT

   Content found on or through this Service are the property of Playbox and/or DP or used with permission. You may not distribute, modify, transmit, reuse, download, repost, copy, or use said Content, whether in whole or in part, for commercial purposes or for personal gain.

10. . PROHIBITED USES

    You may use the service only for lawful purposes and in accordance with these Terms. You agree not to:

    1. Use the service in any way that violates any applicable national or international law or regulation.
    2. Use the service to transmit, or procure the sending of, any personal advertising or promotional material, including any “junk mail,” “chain letter,” “spam,” or any other similar solicitation.
    3. Use the service to impersonate or attempt to impersonate Playbox, a Playbox employee, another user, or any other person or entity.
    4. Use the service in any way that infringes upon the rights of others, or in any way is illegal, threatening, fraudulent, or harmful, or in connection with any unlawful, illegal, fraudulent, or harmful purpose or activity.
    5. Use the service to engage in any other conduct that restricts or inhibits anyone’s use or enjoyment of the service, or which, as determined by us, may harm, or offend Playbox or users of the service or expose them to liability.
    6. Use of the service in any manner that could disable, overburden, damage, or impair Service or interfere with any other party’s use of Service, including their ability to engage in real-time activities through Service.
    7. Use any robot, spider, or other automatic device, process, or means to access the Service for any purpose, including monitoring or copying any of the material on Service.
    8. Use any manual process to monitor or copy any of the material on the Service or for any other unauthorized purpose.
    9. Use any device, software, or routine that interferes with the proper working of Service.
    10. Introduce any viruses, trojan horses, worms, logic bombs, or other material which is malicious or technologically harmful.
    11. Attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of the service, the server on which the service is stored, or any server, computer, or database connected to the Service.
    12. Attack on the service via a denial-of-service attack or a distributed denial-of-service attack.
    13. Take any action that may damage or falsify Playbox ratings.
    14. Otherwise attempt to interfere with the proper working of the service.
11. . ANALYTICS

    We may use third-party Service Providers to monitor and analyse the use of our Service.

12. . USE BY MINORS, WITHOUT CONSENT OF REGISTERED USER

    This streaming service is intended only for access and use by individuals at least eighteen (18) years old. By accessing or using the service, you warrant and represent that you are at least eighteen (18) years of age and have capacity to abide by all of the terms and conditions of Playbox. If you are below the age of eighteen (18), please ensure that you get permission from a parent or guardian before you use our website or give us your Personal Information. We may request your parent/guardian's contact details in order to verify that you have permission. If we cannot verify that you have permission, we may refuse to allow you to use our website.

13. . ACCOUNTS
    1. When you create an account with us, you guarantee that you are above the age of 18 and that the information you provide us is accurate, complete, and current at all times. Inaccurate, incomplete, or obsolete information may result in the immediate termination of your account on the service.
    2. You are responsible for maintaining the confidentiality of your account and password, including but not limited to the restriction of access to your computer and/or account. You agree to accept responsibility for any and all activities or actions that occur under your account and/or password, whether your password is with our Service or you access your account via a third-party service. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.
    3. You may not use as a username the name of another person or entity or a username that is not lawfully available for use, a name or trademark that is subject to any rights of another person or entity other than you. You may not use a username that is offensive, vulgar, or obscene.
    4. We reserve the right to refuse service, terminate accounts, remove, or edit content, at our sole discretion.
14. . INTELLECTUAL PROPERTY

    Playbox, its original content, features and functionality are and will remain the exclusive property of Playbox and/or DP and its licensors. Playbox is protected by copyright, trademark, and other laws of South Africa and foreign countries. Our trademarks may not be used in connection with any product or service.

15. . LINKS TO OTHER WEBSITES
    1. Our Service may contain links to third-party websites or services that are not owned or controlled by Playbox. Playbox has no control over and assumes no responsibility for the content, privacy policies, or practices of any third-party websites or services. We do not warrant the offerings of any of these entities/individuals or their websites.
    2. You acknowledge and agree that Playbox shall not be responsible or liable, directly, or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods, or services available on or through any such third-party web sites or services.
    3. We strongly advise you to read the terms of service and privacy policies of any third-party websites or services that you visit.
16. . LIMITATIONS AND EXCLUSIONS OF LIABILITY
    1. Digital Planet will not be liable to any person (whether under the law of contract, the law of delict or otherwise) in relation to the contents of (including technical inaccuracies and typographical errors), or use of, or otherwise in connection with, the Website: for any direct loss; for any indirect, special or consequential loss; or for any personal or business losses, loss of income, profits or anticipated investment returns, loss of reputation or goodwill, or loss or corruption of information or data.
    2. You accept that, as a limited liability company, DP limits the personal liability of its directors, officers, employees, representatives, and agents. Users agree that they will not bring any claim personally against DP aforementioned persons in respect of any losses they may suffer in connection with the use of this Website. Without prejudice to the foregoing, Users agree that the limitations of warranties and liability set out in these limitations and exclusions of liability will protect DP aforementioned persons, agents, subsidiaries, successors, assigns and sub-contractors as well as holding and associated companies.
    3. By using this website, Users agree to be bound by the exclusions and limitations of liability set out in these Terms and Conditions.
17. . TERMINATION
    1. We may terminate or suspend your account and bar access to the service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of Terms. If you wish to terminate your account, you may simply discontinue using Service.
    2. All provisions of Terms which by their nature should survive termination shall survive termination.
    3. Our Privacy Policy also governs your use of our Service and explains how we collect, safeguard, and disclose information that results from your use of our web pages.

    1. DP and/or Playbox respects the User’s privacy and shall take all reasonable measures to protect it.

    1. These Terms shall be governed and construed in accordance with the laws of South Africa, which governing law applies to agreement without regard to its conflict of law provisions.
    2. Our failure to enforce any rights or any of the terms and conditions as set out herein, will not be considered a waiver of those rights. If any of these terms and/or conditions is held to be invalid or unenforceable by a court, the remaining terms will still have full force and effect.
20. . CHANGES TO SERVICE

    We reserve the right to withdraw or amend our Service, and any service or material we provide via Playbox, at our sole discretion without notice.
